1. About these terms
These terms are between HEMONG DOT ASIA, 201103103176 (002037193-T), [Registered business address] and the business that applies to sell through Hemong (the "partner"). They sit alongside the partner agreement you sign, which sets out fees and payout details. If the two conflict, the partner agreement wins.
2. Joining
To join you must be a registered business, give us accurate details, and hold the licences you need to prepare and sell food, including any required food premises licence. We may ask for proof, and we can decline or end an application.
3. Your account and your team
Owners control who can sign in to the partner portal. You can add store managers and staff for specific outlets. You are responsible for what people you add do, for keeping access up to date when someone leaves, and for keeping sign in details private.
4. Your menu, prices and hours
- You set your menu, prices, photos, opening hours and availability. Keep them accurate and current.
- Prices must be the prices you charge for the same food in your own outlet unless we agree otherwise in writing.
- Mark items out of stock promptly so customers are not charged for food you cannot make.
- You are responsible for describing ingredients, allergens and any halal or dietary claims truthfully. Hemong does not verify or certify them.
5. Orders
When you accept an order, you promise to prepare it accurately, safely and on time, and to hand it to the rider in suitable packaging. Repeated cancellations, long delays or quality problems may lead to a warning, reduced visibility or suspension.
6. Food safety and the law
You must follow the laws that apply to your food business, including food safety, hygiene, labelling and licensing. You are responsible for the food you sell.
7. Fees and payments
The fees you pay and when you are paid are set out in your partner agreement: [commission, payment timing and settlement terms]. The partner portal shows your sales and payment breakdown. Refunds that arise from a problem with your food or an order you cancelled may be deducted from your payout, as set out in our refunds policy and the partner agreement.
8. Offers and promotions
You can create offers in the portal. You are responsible for honouring them. We may pause an offer that is misleading, unlawful or abused.
9. Reviews
Customers can rate and comment on orders. You can reply. Reply politely and do not publish personal details. We may remove reviews or replies that break our rules.
10. Customer data
You may use customer details we give you only to prepare and fulfil that order, and you must keep them private and secure. You may not use them for marketing or share them. See our privacy policy.
11. Ending the relationship
You can leave by giving [30] days' notice, or sooner by agreement. We may suspend or end your account straight away for serious or repeated breaches or to protect customers. Orders already accepted must still be handled or refunded.
12. Responsibility, changes and law
We are not responsible for losses from things outside our control or that we could not reasonably have foreseen, and our liability is limited as set out in your partner agreement. We may update these terms with notice. They are governed by the laws of Malaysia.
